HlB employer and DOL

I am in H1b from oct 2008.I was in project for 20 days in november 2008.

I was not paid in oct(bench) ,nov (where i actually worked on client) and dec 2008(bench).

I sent them time sheet only when i worked for 20 days at client.for oct and dec i havent sent any time sheets as i was on bench.

If i complain to DOL wont they need the time sheets.....for oct and dec....? am on bench i cant provide that...?what can i do will get the money if dont have time sheets.

My company doesnot have a job at their site so am not in VA

You would not have timesheets signed by client since you were not on a project. The DOL representatives are familiar with the problem and will be able to figure it out.

DOL don’t need timesheets. US employer MUST pay you according to wages on LCA. Bench is NOT allowed. If you file complaint with DOL against employer then DOL can recover your wages and can fine the employer.
