I have a problem. I am from Slovakia and got married to a US Citizen last year in October :) . My husband was married before and his ex wife was a foreigner too  . They started the immigration process; she got her Work authorization and temporary Green card. After that they got divorced. Lawyer told us that her status was canceled but even thou he is still sponsoring her? I don't understand it. We have an interview in NYC on Oct 2nd and I am very worried that it won't go though. I am afraid  that what happened in his past is going to stop me from getting my Green Card. Does anyone have any similar experience? Which questions should I expect  ? Please give me an advice....

"When does the sponsor's responsibility begin?
Responsibility begins when the immigrant becomes a lawful permanent resident.
So his ex wife was already a permanent resident before he divorce so yes he is still responsable for that.

When does the sponsor's responsibility end?
A sponsor's responsibility ends when:

-the immigrant becomes a U.S. citizen
-the immigrant receives credit for 40 quarters (about 10 years) of work history in the United States
-the immigrant leaves the U.S. with no intention to return
-the sponsor or sponsored immigrant die
-the sponsored immigrant gets a new sponsor (e.g. if his ex remarries).

Her status is not necessarily cancel after divorce, she could applied for removal of her conditions without him if she had enough evidence that their marriage was bonafide and still your husband would be responsible unless, of course, one of the factors above are met.

So does that mean for me? I know that she had temporary Green Card but I have no idea if she became permanent resident. She only married him, as she said it herself, for Green Card and Health Insurance. When he found out that she opened the credit cards under his name and forced his signature a spent tons of money on them, he filed for divorce. He had no money to sue her and take her GC away. He had no contact with her since.

I think immigration officers will give us a real hard time but I don’t really know to expect.

Thank you so much for your reply Cherr1980!!!
