   You are going to be my saviour. Please share your experience in changing the DOB in passport.

   While I was going through this site, I come across your reply regarding DOB correction in passport.
   I am also having discrepancy in my DOB. DOB in my Passport and birth
certificate differ by a month. I am an Indian. I am going through I-485 route. Can you please give me more details about how you corrected the passport? My sons education depends upon my green card. They are in college and high school. I am worried about their future. I submitted the following docs.
           1.Original DOB certificate,
           2.Two affidavits from relatives
           3.A document from Tashildar stating the person referred in the
documents is same though the date differs.

   Also I am trying to get the Court order stating that my Birth certificate date is correct. The lawyer in India says that he will get the judgement from the court presided by the rank above than Ist class magistrate. Please check your private message for the judgement wordings. The respondant is not any government firms. He is going to put one of my relative (uncle) as a repondant (opposite party). On my behalf, my brother who is a power of attorney of mine is the plantiff. He says he will be able to get the judgement in 2 months time. I started this process 6 months ago. Now he is going to file a case with above details by first week of January, 2001.

  I am having a concern that no government party is involved in this case. Did you involve any government party like passport issuing authority? Do you think the document I receive using above procedure (using a relative as respondant) will satisfy the Indian embassy in US to correct the passport date? If not, please suggest the correct path.

I had my DOB changed in my passport. My passport was wrong by 3 months because my 10th board exam certificate was wrong by 3 months. Like a fool I never got it corrected until the Green Card saga started. It too a very long time in India to get the courts to accept my birth certificate.

Basically the passport office and the central board of education had to give a no objection before the judge could say OK. They never showed up to court for the hearings and the judge would keep postponing the dates. This went on for almost two years and finally the judge gave the OK. From what I understood even though it was not their fault we had to sue these two organizations (not sue as in hold them responsible but more as in their no objection is required. Your case may be different.)

Once I had the court papers, I went to the US embassy in Washington DC to get the date of birth corrected. After speaking to them on the phone they said this will not be a problem, but when I got there they refused to change it. I called back and spoke to the officer in charge (Our wonderful IAS/IFS people) . He said no problem and come by tomorrow and I will fix it. The next day they refused again. Coming up with all sorts of lame reasons including that the stamp on my BC was not from the day I was born. Implying that the only valid BC is one you got when you were born and that new copies issued by the city are not of any value.

I called and talked to the main guy again and set up an appointment with him The next day after waiting for several hours I met with him and he gave me a long lecture on how bad I was for not correcting my DOB issues earlier. The bastard even went on to to talk about my parents and blamed them for a mistake made by the CBSE. Anyway, I just sat and listened and finally he stamped the correction on my passport.

All said and done, you should have no problems except for the fact that the bureaucracy will really drag its feet.

By the way. For the GC I submitted the original BC with a note saying the DOB on the passport was wrong. Never got questioned on the issue. Submitted my LC and I-140 with this note. I think the INS is a lot better than Govt of India in these matters.

   Thanks and appricate for taking your time to help me. I have few questions. Please clarify.

  1. You mentioned you had waited for 2 years. Did your I485 approved before you got the court order?
  2. Is there a possibility for rejecting the I-485 if DOB is not corrected on time?
  3. Can you please put in the private message the wording that appears in the order? I am not sure, my lawyer\'s suggestion is correct. He is planning to get the order from the court without involving (sueing) the passport and educational autthorities. As I explained in my original message, he is planning to have opposite party as one of my relative. This will not have any direction to correct the passport. Simply it will mention the correct DOB is such and such.

Hi Mogaram,

In my case all my documents ( educational, Labor, I140 ) etc matched the DOB in my Passport. But the date on my BC was different. As far as INS is concerned, The evidence of birth is the birth certificate issued by the registrar of births in the place of Birth. The passport DOB does not influence I-485 processing. So If you have filed your I-485 with the date of birth as in your BC, then INS will not have any problems processing the application. The problem arises when you want to travel because then you have 2 legal documents identifying you differently which may cause problems at the borders.

In my case I had to prove why there was this difference between the BC and the rest of my documents. Also, I had used my School Certificate as proof of my birth date when applying for my passport which is the date entered in the passport.

So What my attorney did was to prove that there was a genuine mistake made at the time of registration in School by my parents and that this mistake carried forward to all of my important documents including the passport. In my case The Regional Passport Officer was the respondent and my mother was the petitioner ( This is not usually allowed by the courts, since I should have been the petitioner. In this case the Judge was lenient enough to accept my mother as the petitioner in light of the fact that I was working abroad ). The petition stated that a mistake was made at the time of registering in the school and that my school leaving certificate was used for applying for Passport. To prove that my date of birth was correct, my mother and grandfather prepared an affidavit each stating that the DOB in my BC was the correct one. They also produced my horoscope to corroborate that and my mother was asked to testify to the judge. Somehow all of this worked out in my favor.

In order to save time, your attorney should first write to the Passport office asking them to correct your Passport. The Passport Office is going to reply asking you to produce a court order. Take this reply and then only file your petition to the court, because the courts will always look for jurisdiction. This letter from the passport office will give them that. Produce enough documentary evidence to explain the discrepency between the Passport and the date of birth. Then hope for an understanding Judge. The Passport Officer will never appear in court so they would postpone a couple of times. But since you have the reply from the passport office, it will not be postponed indefinetely since the letter proves that the Passport office already is aware of the case. So, it will help to involve the Passport Officer as a respondent. I had absolutely no problems at the Houston Consulate General. They just accepted the Photocopies of the court order along with an Enlish Translation ( Notarised in India as True Copy) and in 1 week I got my new Passport with the correct Date of Birth with no questions asked.

Then I had to correct my SS records and Drivers License etc. over here and the whole mess keeps going on and on. For these I just used my EAD card so it was not too much of a Hassle. Obviously now I have my H1B, I-94 and Visa stamps still reflecting the old DOB. But then the EAD card or the GC will set things right going forward.

Mr. Net,

I do appreciate your response and sometimes what you have said do work. I tried those but it did not work for me. But keep in mind that certain things are best when left unsaid when in public view. A private mail would be a better option for some of the ideas you wrote. Otherwise it could do immense harm to the immigrant community.

Need help in the correction of DOB from CBSE

I am also facing the same issue of DOB.DOB certificate from Municipality has different DOB compared to School documents ,Passport.

Have you done the correctio of DOB in hyderabad? If so would you mind in sharing the details of the attorney/lawyer for me to approach him as I 'm also in similar situation to get this corrected. Appreciate your help. Also, can you please let me know how much you have to pay to get this whole process done ?
