Hi Jaxen/Jim,

I'm planning to apply H4 for my wife in India(Chennai consulate) next month.Hence,do you recommend to submit my I-129(i.e certified) and workplace pictures along with the other required documents? or it must be submitted only upon the US consulate's request?

No harm in sending those docs if you do not have a H1 visa stamp in the passport. Otherwise not required...

Hi Jaxen
I have very imp. question for you. My current H! expires in May2003, my company has also filed for the extension since December, I am planning to go to canada to get the H1B multiple entry stamp on my passport on March2003.

The question I have, can I leave the conutry and come back while my H1 extesion application is still pending? This is because when I come back i will be issued a new I94 card at POE which will be different from what I have send to INS with H1 extension application.
Also If I go and come back to US and after 2 months my extension will get approved, will the new I797 have I94 in it?
 
U are choosing a very wrong time to do the H1 stamping. Read the archives as to how to fix I94 problems...

Hi Jaxen
What do you mean by wrong time to do H1 stamping? Actually I need to go to india in March'03 for some important stuff. So I was planning to get the stamp from canada till May2003 and then travel to India.
I spoke with my lawyer and he told me that you can leave country after application of H1 extension, but you need to be in US when it is approved. But I thought to have second opinion, since my lawyer had been wrong couple of times.

Jaxen, I would be glad if you can put more light on it.
