HI issue..someone plz help me..

hi all,
I entered US on 4th OCT, 2004 with a H1B visa(from a consultant). Its been one week now. I was thinking like I'm gonna be getting trained in QA and get a project. But unfortunately, the consultant says therez no QA training going on right now and I need to get trained in something else and should find a project within 30 days of my entry into US. I'm thinking about transfer my H1B visa to someother consultant. But people say, its not possible as I need 3 paychecks from my present employer if I wanna do so. Somebody please reply me, if there is any way that I can transfer my visa to someother consultant.

its general practice for uscis/ins to ask for 2-4 paystubs but obviously as you entered just this month you should be ok if you present just one (depending on your employer payroll frequency).

from your posting its understandable that your employer dont pay on bench (meaning you will not be paid for non productive work hours). per law your employer MUST pay you irrespective of whether you work in project or not (except if its YOUR voluntary leave). wait till 2nd week of november. if you dont get the pay check then complain to dept of labor (www.dol.gov).

Get atleast one paystub from your consultant and initiate h1 tranfer to different company .
One paystub is good enough for transfer.

Can you pl share your stamping experience in chennai.

You might not have even got social security number. Wait for some more time donot keep jumping from one to another that is not good for you in long run. But there is nothing wrong finidng the possibilities. Although you are required to pay no consulting company pay you till you get into first project.

New H1b - Change of employer

Hi,

I am also in same situation, but I am in India. I got my visa two months ago. Current company is not at all good. I am planing to change employer. Can I come to USA on current visa and go to a new company and apply (H1b) change of employer that week it self?

It was done earlier for some one in 1998...

But not sure this time... If any one had change employer and had any experience in this situation, please through some light.

I successfully transferred my h1b after 6 weeks working for initial sponsoring compaby, without any payslips, using employment verification letter.

How do you transfer your H1 B? Can you point me in the right direction as far as forms? Any help is appreciated. I think I might be getting laid off with my present company and I need to start thinking about these things. Thanks
 
Best bet is to starting looking for reputable company that will transfer your H1b. Such companies provide decemt lawyers who know how to complete transfer successfully.

Since my last post I learned a few things. There is no H1 B transfer, you have to apply for a new one. And as long as you get receipt from immigration you can transfer to new company. I have new company lined up, only I'm short on money so I will have to do the H1 B application myself. Yikes! I know but I have no options.

Can anyone provide a few things to keep in mind while doing this on my own.

I know I have to file I 129 and LCA any additional suggestions might help a guy in need. Thanks
