Hi hadron or any one ,

I already posted my situation in the previous post, now I need your suggestion.

I am doing my 3rd year residency in IM on H1B visa; my visa is going to terminate by end of Feb due to 6 years term, I can recapture 3 months till end of May. But still I will be shortage of 3 months to complete my residency.

Program is not ready to waive 3 months, do you think doing 3 months external rotation in India and come back after one year on H4 is advisable ?

Now I am getting one J1 waiver offer, so I need to take decission

Can I switch my visa status to J1? and go for the J1 waiver job.

How long it will take to switch from H1 to J1 ?

When I have to apply for J1 ? When I have to apply for J1 waiver to come under conard 30 ?

If I don't apply under Conard 30, still can I get J1 Waiver ?

Thanks.

I am not Hadron, but I have been on J before. It is an expensive and exhaustive effort to fix it. If you were in the begining of your IM and had a cardio/GI fellowship lined up I might have recommended J. In your case the options would be, O, if you can. Otherwise see if the program will help for international rotations, need not to be in India, could be Canada or UK-might look better on your CV. I am not sure what will happen if you filed for PERM right now if you have a tentative job cooking, or even NIW with that waiver job. The rest of gurus will have to tell how long would that take to get an EAD, so you might be able to join a practice. One other option would be F1, lets say for MPH, and then get OPT for preventive medicine rotations, but again I don't think that will come through very fast.

H1 time expiring b4 end of residency ...

>>>> Yes.

How long it will take to switch from H1 to J1 ?
>>>> about 3-4 months. (you will need "statement of need" from your home country + ECFMG processing time + USCIS processing time for COS from H1 to J1). see ECFMG website for details.

When I have to apply for J1?
>>>> After you get the DS2019 (former IAP-66) from ECFMG.

When I have to apply for J1 waiver to come under conard 30 ?
>>>> after you have been on J1 in USCIS records --> This will happen when-
-- your applications for COS (change of status) within the US is approved OR
-- when you enter the US on a J1 visa if went outside the US to get a J1 visa stamp.

If I don't apply under Conard 30, still can I get J1 Waiver ?
>>>> Yes. waiver is supported by any of these - VA, Conrad State 30, HHS, ARC
+
theoretically as per the law "department of health in any state." (I don't know of anyone who got waiver via this)

or even NIW with that waiver job.

not to do residency
