I just got a email from my lawyer saying that they have received a FP notice scheduled on FEB 8th. My details are as folllows

PD 03/22/99
RD 10/27/00
ND 11/22/00
GOT EAD AND AP

Travled on AP. Still have valid H1B approval.
Someone can tell me Is Am I on H1 OR EAD ? I didn\'t filledup I-9 form after I returned to US. Thanks in advance.

You are still H-1B, as long you haven\'t actually used your EAD for any other employment (including presenting it to your current one as proof of emploment authorization).

Applying for or getting EAD does not void your H-1 status.

It\'s good news that we are seeing some ovement on Nov. 1999 cases. Looks like October wasn\'t as big a load as Sept. and October 1999.

OCT2000: If you have travelled on AP, that makes you to be an EAD candidate if you had a valid H1 then you should have used H1 to travel, since you did not do that that makes the usage of EAD valid because it is that status that you invoked when you had a choice. There is nothing wrong in that it is just that your H1b time has frozen since that time, actually if there is a need you can use that time later...

Is this true once you use AP for travel
your AOS process goes back to six to eight
months? I have valid H-1b by the end of
2001 and also travel visa stamp on passport
til the end of 2001. Have received AP and
EAD and none of them has been used as yet.
Want to travel by the end of march 2001
for two weeks.
Please share your thoughts. I will appreciate it.
It will help lots of us out there wondering.
