Here is my I-485 RFE

On the RFE I-485 below, by "submit evidence that any and all employment since your last admission" do they mean last time I came to the US in 1999 on H1B, or do they mean since last time I entered the US (Christmas 2005) ?

You must submit a currently dated letter from your intended permanent employer, describing your present job duties and position in the organization, your proffered position (if different from your current one), the date you began employment and the offered salary or wage. This letter should be in the original and signed by an executive or officer of the organization who is authorized to make or confirm an offer of permanent employment. The letter must also indicate whether the terms and conditions of your employment-based visa petition (or labor certification) continue to exist.
Submit documentary evidence of all nonimmigrant status granted to you from October 10, 2003 to February 22, 2005 Please also submit evidence that any and all employment since your last admission has been authorized by this Service. Such evidence may include, but is not limited to:
Copies of both sides of your Form 1-94 Arrival/EnUy Document;
Copies of both sides of your Form I-20A-B/1-D (F-I students and dependants);
Copies of both sides of your Form L&P-66/DS-2019 (J-l exchange visitors and dependants);
- Copies of any Form 1-797 approval notice/notice of action;
Copies of the pages in your passport which show U.S visas, Service admission stamps or
other endorsements, to include the passport identity pages;
Copies of any and all Employment Authorization Documents (EADs) issued to you by this
Service.
You must submit a properly completed Form G-325A, Biographic Jnformation Sheet for yourself. Your original signature is required on the Form G-325A. Photocopied signatures are not acceptable. Blank immigration forms and information are available online from the official Service website: www.uscis.gov. You may also order immigration forms by phone at 1-800-870-3676.
Please submit proof of your continuous employment authorization in the U.S. from June 1999 to October 11, 2001 and from June 7, 2004 to May 14, 2005. Such evidence may include copies of:
Employment Authorization Documents (Forms 1-688 or 1-766) granted to you by this Service Form 1-797 approval notices, showing you were granted status in an employment-authorized
nonimmigrant classification
Copies of Form 1-94 Arrival/Departure Records showing you were admitted to the U.S. in an
employment-authorized nonirnmigrant status

I-485 RFE - marlon2006

Hi Marlon2006,

I got a similar RFE requesting copies of all my I-94 and I-797 from 2000 onwards. I have copies of I-797 approval at my end, but not all of my I-94, as I travelled couple of time back to my home country and handed over at that time.

I had copies of the all I-797 and I-94 for myself, my wife and daughter and now do not have any issues in submitting the same. I also have the payslips and W2 forms received during those period as well and sent a copy of them along with my other documentary evidence to my attorney.

If you had them, then it may be easy for you to establish your evidence. I hope your attorney will be able to handle these RFE's effectively and guide to accordingly.

I will talk to my lawyer about it, but I hope I don't need to submit paystubs, I though mine below was related to employment authrization only.

replacement of old I-94

Hi nlssubbu and all,
I realized that I do not have the copy of the I-94 from my F1 status (1997). But I do have all from my H-1 status. I guess I will have a problem here in I-485 (submitted).

Is there any way to apply for replacement for old expired I-94?

Replacement / Copy of old I-94

I know that you can get a replacement of I-94 for the current one, but not sure about the old one. If you have proof of your F1 papers and establish that you are entered in this country legally, that should suffice.

Consult with your attorney regarding this, who can be of helpful. They may able to guide you what document you can prepare to take care of this.

Your passport is stamped at the Port of Entry. This stamp contains the place of entry and the date and sometimes they fill the visa classification you entered under and how long its valid. Look at your passport. You can prove you entered on that date using a combination of this stamp and your visa that is valid during that duration.

You are right. My wife got a "legal stat" RFE last year and we submitted her latest I-94, I-20 and copies of the passport page with the entry and exit stamps during the years they wanted us to prove her "legal status".

Yesterday was my stressful day. Finally, I found this document at home which I thought was lost and did not submit with I-485. So probably they will issue me an RFE.
Just for your information my passport does have date of entry but not Valid Unitil (in may case D/S).

Thanks. Dont want to make you feel bad, but your RFE looks pretty comprehensive. I filed my 140/485 in Nov'03 and got RFEs for both in March'05. Replied and 140 got approved soon after and 485 stuck like everyone else's

I was just wondering (and hoping) I dont get "one more" RFE on my 485. They did ask for Biometrics this March'06 and I got that done.

I am truly hoping mine is in "pre-adjudicated state" as many speculated there is something like that, that exists.
 
I think it is hard to draw conclusions from this. USCIS operates in secrercy. I am not sure whether getting RFE's now or ealier are indication of anything special. A House of Representative staff member told me that name check and security has been cleared a while back for my application. They requested the biometrics for myself and wife back on March 2005.

Not as much as a matter of "anything special" if you get it soon after filling or much much later, but as regard to how many RFEs of similar nature USCIS would end up sending to I-485 petitioner if considerable time passes between the two.

I know there are no stats or any logic what so ever, but I would hate to go through another RFE of similar in nature that I already responded a year ago, especialy that I have since changed jobs.
 
That's an interesting point. After responding my RFE's, I am wondering if indirectly I would have a better chances to go through the process OK if I just change jobs and have my employer not notifying USCIS. Interesting.

Well you can/should notify USCIS when you change jobs as you shall be covered under AC21. The reason some don’t (me for example) is why raise unnecessary suspicion and hence trigger a potential RFE when the new job may not be an exact match.

So we hope that USCIS already raised an RFE and chances are will not again for the same reasons.

I got a 485 RFE today again after 1.5 years, God knows what this is?

As soon as you receive it, please let us know what your RFE is about.
I guess longer it takes to get processed approved, more likely USCIS can trigger an RFE to make you give a heartbeat.
