Guys and Gals,

The much awaited month of October is almost here. Its ironic how the month that was being so eagerly awaited by us immigrants brought us such misery. Oh well, the good part is that every month only lasts for so long and Oct 05 shall pass to. The way I am forcing myself to look at things is by asking myself a simple question, how much worse can it get for us immigrants? This makes me beleive that things can only improve from this point because we have reached the bottom of the pit at the moment :)

Now lets see what the Nov bulletin has to say. I bet its going to be a replica of October. I only forsee some movement in January.

As I always say "These dates do not mean anything". We did so much of speculation about what would be the PD in October and were in a rude shock when the actual visa availability dates were published.
USCIS does not believe in FIFO. When my I-140 was approved, the dates were current. But some wise guy in TSC decided to transfer my I-485 to local office instead of approving :mad:
While waiting in line at Dallas local office, the dates retrogressed and then after a couple of months they passed my PD but still nothing happened (inspite of my monthly visits for followup). Finally I was called for interview when the dates have retrogressed again.
So we have to just wait patiently and wait our turn :)

I agree with the above post.
Currently it looks bleak.
It will definitely get better. Hopefully by Nov/Dec we will get a better picture.
 
Retrogression is an expiation for INS's sins :-)

The only silver-lining one can see in this Retrogression is that it will now make sure that there is some proper FIFO processing in place. No more will we get to see 2005 May cases being approved when August 2001 and 2002 cases are pending etc. In other words at least the availability of visa numbers will dictate how the FIFO comes into the proper with the approvals of I-140 and I-485. At least this will ensure that the concurrent filings of I-140/I-485 will not affect others who are already in queue. However, for folks like you and I who have already received serious drubbings until this far, it is not a real advantage. But, that's what I said as "silver-lining." :)
 
Need to be patient till end of 2005

I am a silent spectatior and this is my first post.

What I noticed so far is that the process by BCIS is so unpredictable and depends on many variants. PD is one of them. I also noticed that there are cases pending and approved without any relation to date of proessing timings. I do not even wonder if there are many approvals in Oct.
 
FIFO! Sure!

Those of you who think that P.Centers follow or will follow FIFO are quite naive. Remember this is a selection process where the applicants are more than the number of visa's available.

The candidates who have received their approval in a short period were perceived as being more beneficial to the US. This could be because of education, years in US, age etc..(don't really know).

I am sure you will continue to see old cases being processed alongwith recent applicants as the P.Centers deem fit.

Yes it may be frustrating, however, it is reality.
 
The only hope you have is going back to India and making good money over there. Do that now other wise this chance will also go away and you will only repent later.
 
Actually 1947 will be a symbolic retrogression year for all EB categories for India. Then we got freedom from the Bristish and now from being documented skilled workers is USA ! :)

I think we talked about this before but I wanted to ask you once more. I am originally from Greece. I got my card in July, but my husband's case is still pending. Do you think that even if Greece is not in the retrogressed countries it is still affected by the visa number availability?

Long time now see. I was away for a few days. In fact, I decided to stay away and wait until October is here. Well, it looks like, October does not mean much for us EB3 applicants. I have a question though. I never paid any attention to retrogession since I did not fall under that category. Now I can see that there is a date for rest of the world as well. I fall under the category of rest of the world and my priority date is February 8, 2001. 140&485 filed concurrently on October 12, 2004. 140 approved in July after all that you already know. My questions is this. Is it possible for my 485 to be processed this year or there is no hope or no telling? I would really appreciate your openion on this.

Good to hear from you. Regarding your question about your husbands approval. His PD is the same as yours and you guys fall under the "Rest of the world" category. I am not sure what the current PD cutoff dates are for the rest of the world but basically till that cutoff date does not pass your husbands PD date he will not be approved. Check the latest visa bulletin for the EB3 PD cutoff for the rest of the world.

Hope you have a safe and enjoyable trip to Greece.

Huifang,

Your PD is the date your Labor app was filed at the State level. If that PD is before the cutoff date, then you have a chance otherwise you will have to wait like the rest of us.

Thank you Saras76. We finally received the emails this morning. Our cases have been approved and cards were mailed. I don't know if we still need to make an infopass appointment to get our passports stamped or wait for the cards in mail. Thank you again for all the valuable information that you have been sharing with all of us. Good Luck to you, POJ and everyone else who is waiting for the end of this long road.
