Hey Guys,

I need your help deciphering this situation. I'm not very familiar with immigration law, so hopefully you guys can help.

My girlfriend is currently 22 and has overstayed her Visa (she was only supposed to be visiting for 6 months). She came here when she was 14. She came with her mom and they both filed together. Her mom was seeking asylum in the US because her husband was a political target in Bangladesh. Her mom finally got the asylum status a few months back but unfortunately her lawyer said they cannot do anything for her since she is over 18, even though she filed with her mother originally...

Is the only option marriage if she wants to legally obtain status in the US?

I am a US citizen by the way.

Thank You

The cut off age is 21 as of the date the application was filed. Her age on the date of approval is not relevant.

Do you mean as long as she filed with her mother (which was before she was 18), she should have been set?

Yes as long as she was under 21 when they filed (assuming she is not married which is not based on your post).
