Hi everyone
let me explain my situation.
i am a foreigner in usa with h1b visa. i'm planning to stay in usa as long as possible, but in the meantime i want to have a backup with canada PR, and possibly a canada passport later
If i apply for canada PR, and receive the PR, I want to just keep it and keep working in usa until my green card application is approved. but since now it's harder to get greencard, if i don't get it by 4 years, i will move to canada.

the problem is i want to apply from usa and stay here for a while. however if i get a PR canada, i might need to land to canada and am afraid to enter canada, since i dont have h1b visa stamp and i avoid going back to home country to get stamp.

second issue, the min stay is 2 years out of 5 years, if i'm not wrong to maintain canada pr. is there any workaround? do they actually stamp the dates when i leave or enter canada by seattle border or other way?

----- Many applied Canada immigration in your situation, but Canada has no jobs in IT if you still want to apply go to cic.gc.ca and check if you qualify, it will take 18-24 months from date of submission( may be more)

------ Once you get Canada permanent residence no need to fear, you can land and go back to US you can be out of Canada for 3 years, If you don’t have H1B visa stamp in your passport you should get it from your home country or if qualifed then Revalidate from DOS in US or you can also get H1B Visa stamp in Toronto or Mexico, I don’t understand why you avoid going back to home country to get the stamp, did you submit fake educational degree papers to get H1? Or committed any crime in your home country?

------ At the time of Landing you will get stamp in your Passport from Canada immigration, for the next trips after landing you may have to show PR card after 31 December 2003 to enter Canada

let me explain more about my posting

i am afraid of going back to home country because i'm from indonesia, which majority of religion is islam. although i'm a christian, it will not make any difference in terms of 'special' treatment that the us gov't has been doing to moslem countries so far. it is very difficult to get a visa stamp and many people got rejected. it's sad, but many people are purely coming to usa or canada for better life, not for doing any harm, but i think i shouldn't discuss about politics and discrimination here.

btw, my area is not IT, and glad not to be in it. i'm an MSEE

can you tell me what DOS is and where i can find info on that?

Once you land in Canada, your home country is now Canada. So you could go to the US consulate in Canada for your H1 stamp.

Experts, do you see any flaw in my above comment?

----- He has NOT landed in Canada and is NOT PR of Canada at this time, he/she is thinking of applying for Canada Immigration, read the post before replying, he may go to Canada to get H1 stamped but if refused he has to go directly from Canada to his home country and can not enter US if H1 Visa is refused in Canada or Mexico.

--- You have not read poster question in detail, he is not Permanent Resident of Canada at this time he is on H1B working in US and with out H1 Visa Sticker in his passport, if he has valid I-94 he is OK but he may want to travel out of US and has problem to enter back as He has no US valid Visa in his passport

visit the below site of DOS and read the info if you qualify for H1 visa sticker revalidation other option is Toronto they have issued visa to Muslims in past I have read in other thread that 3-4 person in your situation got the H1 from Toronto US Consulate you can go to H visa threads to get more info or post your question in detail to those threads you will get the exp of many:

a canadian PR's home country is NOT canada. The home country is one you are a national of, not a resident of and as long as you don't have a canadian passport, canada is not your "home country"

to the poster,
you will not have to enter canada for a loooooong time to come.
right now you are just planning to apply, it's going to be easily 2 yrs by the time you get the PR and after you get the PR, till one year back, each PR was given one year to land from the day they received the PR. Thus, if you get your PR in 2005 (being liberal here), you still got one yr from that point to land in canada. enough time to determind ur US GC?
 
When you apply for a visa at the US consulate (if you want to enter US and require visa - ex: Indian national), as a Canadian PR, you do not pay the "Reciprocity fee" (in addition to the application fee) since Canada is your home country (as I was told by the officer at the consulate) as a Permanent Resident, not just a resident.

For non PRs from India (for ex), you pay the reciprocity fee. This is from my experience a year ago. I don't know if the same applies for Cdn PRs not living in Canada.

By the way, do they still collect "reciprocity fee" or has that thing been eliminated?

You are absolutely right as to the visa procedures if ssg10 enters Canada before becoming a PR. In fact, ssg10 cannot enter the US if the visa is refused even after becoming a PR. However, reading ssg10's posting, it looks like ssg10 is talking about being afraid to enter Canada for the purpose of landing ( and not before that) since ssg does not have a visa stamp. Excerpt of ssg10's below.

yes, i am afraid to enter canada without h1b visa stamp in my passport, since i wont be able to enter usa if my visa stamp is refused by us consulate

i wish i had my h1b visa stamp already, so that i could just send my passport to DOS for revalidation, but i dont have the stamp, because i recently changed my status from F1 visa to H1b

I had recently tried the online test for canada PR, and i scored 72 out of 75 passing score. do you think i still have a chance? i have no french language background, that's the one that can help me go over 75
