Hi, I'm currently working as a business analyst with my H1 status. I got an offer a few days ago to work part time as a waitress at a restaurant.
Since I don't want to work illegal here, I need some advise. Is there a way that I can work there with a valid status? Can I apply for an EAD while on H1 status? What is the requirement? The reason I'm not applying for another H1 because of the job description. Waitress is not a special occupation.

You cannot work as waitress or take up other non speciality occupations. EAD is for people whose I485 are pending or who are on F1 -OPT... H1 cannot do EAD based on H1. Moonlighting is dangerous while on H1 with no GC application pending...
