Guys,
         My PD 12/97 I-140 approved 7/99 ND 9/99 fp 9/00. Case on hold due to company name change. My company says I cannot file for an amended I-140 because I have an approved I-140 but in the earlier company name. If I file now It will be a refile and will sit in the VSC I-140 queue for 10 months. They are advising to wait for ac-21 regulations. Advise gurus !!

What the company is giving you is plain BS !!! All they want is you to stick around for as long as possible. There is nothing that prevents you from filing an amended 140, in fact that was the thing to do unless this new regulation.

You have to be firm and stand your ground. Ask your company for reasons and opt to pay if it comes to that.

I agree with Naveen. I would get the amended I-140 filed right away unless this regulation is going to be in effect in another month.
