I am working on H1 with a company in USA. My current employer has LC for my GC and my I140 and I485 are about to be submitted sometime this month end. I am in between projects and will be out of payroll if I don't get a project by February 2004 mid. But the employer is willing to continue with my GC process.
Please advice.
Thanking you

Please inform your employer that you will be out of status if they take you "out of payroll".
GC can continue as it is for a "future job" so your employer is right about that. They cannot take you off the payroll unless they are terminating you. That would be considered a H1B violation as they have to pay you the salary stated in the LCA (not LC) at all times during your employment.
