Help with TN visa letter

I am planning to apply for TN Visa and have gather all documents. The only thing that is missing is the TN Visa letter that needs to be shown at border. I'm applying under the category of Computer systems analyst and my specialization has been in Database technologies.

I needed help if anyone has drafted any letter from this background under the Computer systems analyst category so that it is easy for the officer to understand what work I will be doing. I don't know if every letter under Computer systems analyst should say the same thing or it will be different if the background of a person is from Database level or Application level.

I have got the complete format, the only thing I'm missing is the contents that can relate my background the category I'm applying for? Also please confirm if Computer systems analyst is the category I should apply if my background is in Database technologies.

The letter should not talk about you and your quals. The sponsor would not be trying to hire you if you were not qualified, so the border assumes this. The TN letter, which should be prepared by your sponsor by the way, not you, should contain only the job description, the TN category they are requesting approval under, and remuneration details, and the length of employment, that is, factual items which are under their control.

It is then up to YOU to provide the necessary documentation of your work and/or education background, separate from the TN letter. CSA requires a related bacheleors degree, or alternatively, a two-year realted diploma and 3 years of documented experience.

As to which TN category your sponsor should be requesting, it should be determined by the JOB you will be doing, not your background.

Quick question I had - The actual company doesn't want to write a TN letter, so the employment agency/company who placed the candidate at the company, is writing the TN visa letter. Does this still work and is valid to at Border? . The TN letter will still mention the actual company's name, but not sure if this will is OK.

Any loop holes do you see in this and may cause a problem?
 
This works, but realize then thatthe agency becomes your sponsor, which is probably a good thing. You might want to ask them to make the letter more general, so that, if the firm you are currently looking at decides not to keep you, the agency can send you elsewhere without having to redo a new TN application.

Something to think about.

So even if the candidate is on Payroll of Actual Company and not of the Employment Agency, this should work? The Candidate can just say that the Agency is doing the Immigration paperwork and the Payroll is still from the Actual company. Does that work and is eligible to apply for TN?
 
It depends on what role the agency has. From what you say, this was merely a placement agency. If that is the case, then they should not be thesponsor. If they are willing to prepare the letter for your firm, that is fine, but then the Actual company should be the sponsor, TN letter on their letterhead, and signed by someone at that firm.

This is NOT the same as an employment agency to which you report you time every week, and they pay you.

Hope you are doing good.

I have a got a TN Visa where i'm currently working as full time and I'm getting offers from employment agency ( i will be on their payroll and work at client site). Do you feel it will be somewhat complicated and difficult to get a TN Visa?

1) I'm not sure what can be the contents of TN Visa letter here, does it say that this candidate works for us as a ROLE, or should it say this candidate will be placed at different client sites at this ROLE. Are there any loop holes i should be concerned applying for TN in this case?

2) Additionally, my wife who is Indian she got an approval from US consulate for TD visa (the border STAMP is still pending for her because we haven't been to the border yet) - this is based on my current TN visa and full time job I'm doing. If i change the job (going to a different employer: employment agency), would she need to go again at US Consulate for getting visa approval now for this new employer OR we can straight way go to border?

3) I got the current job a month ago and am planning to do a chance since it isn't working as expected, do you feel it should be ok or i should be prepared for more questions? Does saying this suffice: I'm not finding career or growth opportunities as i expected before joining?

(1) It should say that the aganecy will employ you, sending you to various clients.

(2) Your spouse is in TD status based on ANY TN that you have. As long as you maintain TN status, even after changing several times, her TD visa stamp and her I-94 remain valid.

(3) This is normal. Just remember not to quit your current TN job until you have secured the second. You can have several TNs at same time, so do not give back your I-94 too soon.
