help! will citation cause denial of 485?

Hi, friends, please help me with a question. I was once cited by a cop for posting ad (looking for a roommate) on the wall. I went to the court and the judge dismissed my case.

Will this case cause the denial of my 485? I am expecting an interiview for this already, but I am really scared of denial.

Can anyone help me? Especially those with the same experience. I will be very grateful to you guys.

ABSOLUTELY NO WAY ... only if it is a felony (i.e. can reult in crimial conviction). The reason felons are not given GC is because the applicant may end up in prison after GC and prisoners are actually "charge-of-state". A citation is misdemeanor (like littering citation or a parking ticket) and you won the case anyway, so don't worry and enjoy the rest of the weekend. ;)
 
I think you should be alright. First the case was dismissed by the Judge, so there should no criminal record, although a citation for something like posting an ad would at the best be a misdemeanor and may not be even qualified for the record.
I assume that you were not arrested. If you were I would suggest that you go to court again after 3 years and impunge the arrest record as a first time offence. If you were not arrested I dont see any problem at all as there shouldn't be any rap sheet on your profile. If you are too worried about this, with the help of a lawyer, try to invoke the FIFA(Freedom of information Act), to see what is in your personal records with FBI and the state.

thank you guys, I don't know what is the definition. He did not handcuff me, neither was I taken FP by court. I just went there and they dismissed me. They did not even fine me a buck.

I was scared because I was reading another post of shoplifting. IF my case is defined as middemeanor, it falls into the same category as shoplifting, which scared shit out of me.

By what you are saying I dont think you were arrested, because I hang out with a few friends who are cops and I do know a little bit about these. Even if you voluntarily turn yourself in for a charge, the cops put the handcuffs on you as a procedure and take fingerprints and mugshots. Since none of these happened, your name should not even be in the county database(much less state or Federal..). So take it easy have a beer and the next time when you post an ad on the wall, first look around ;)
 
YOU WERE NOT ARRESTED BECAUSE WHAT YOU DID IS NOT A CRIME - IT IS A MISDEMEANOR

By law a arrested person has to be read the Miranda rights ".. you have the right to be silent, right to councel, etc etc" and also you would have been handcuffed.
 
I do not know whether submitting a sworn statement (DS 230
Part II ) is part of the 485 process. It is part of the consular process.

If that is so, there is a question there, which asks whether you
were ever charged, detained or arrested for any offence.

Even getting a traffic ticket merits a 'Yes' answer here. You would
ofcourse follow it up with the copies of records.

In your case there is no problem at all!
