my I485 denied from los angeles office. I filed MTR.

What's my current status..

My 2nd EAD got aprroved after denial. Currently I'm not working. Letter said, EAD/Ap terminated. Is it true.

Can I use my 2nd EAD and start working again. When I checked with attorney murthy's office, they said I can stay out of status only for max 180 days. Also, I cannot work.

I read the LonGC thread, looks like I'm worrying too much for nothing.

If I have legal status here after filing MTR, can I start back work.

Any inputs will be appreciated.

would u like to share if it is not inconvenience for u what was the reason to deniel.

Was it deniel or NOID? and reason?

my case got transfered from TSC to Los Angeles office end of sept'04.
Went for interview on Dec'04.
Received denial letter on Feb'05, saying I140 was withdrawn by my sponsoring employer. I changed employer after 180 days of filing. At that time I had my I140 approved. At the time of interview officer didnt mention anything about I140. I didnt file AC21 portability letter, but i gave the current employment letter with W2's and paystubs. He said, since change of employer he need to review it again. Which made him deny.

When I checked with my employer A, they filed and I140 and, withdrawn, b'cos mine was a substitue case. The after a month they filed another I140 which got approved. Only after the 2nd I140 filing they filed the I485.

I believe they linked the wrong I140.

Anyway, my denial letter was issued on Jan 13th, when received the letter it was on Feb 5th. So I had one week to file MTR. I didnt have an attornery, I was looking for attorney, noone seems to help me within one week. I contacted murthy and they helped me out in filing the MTR in 2 days.

They said, I'm out of status. I cannot work. 180days is the max, if I reach that I have 3yrs barr.

I read LonGC forum, now I'm confused.

Now I'm not working... Dont know what to do.

1st I765 - RD Oct'02 still not approved, transfered to local office Feb'05
1st I131 - RD Oct'02, got aproved on Oct'04, never rcvd aprroval notice, msg changed back to RD
2nd EAD - RD Nov'03, AD April'04
3rd EAD - RD Jan'05, AD Feb;'05 (after denial)
2nd AP - RD Jan'05, AD FeB'05 (after denial)
 
I believe your case would be apporve soon, as almost all MTR cases were end at approval, ur case is cleared. ur only issue is to continue work.

if you talk to them(ur empl) and ask that u would continue work and the pay stuff to adjust later. this is not a big issue. if they understand ur situation.

Murthy is attorney and if u hear from them that 180 max story, thay may have said because of some base, u can reconfirm to them.

Thanks for sharing with us, I believe don't worry much about it, you will get approval soon :D . I can feel and tell that ppl who are going through only they know and God now about it. anyway.... think in this way. believe on ur faith (whatever your faith is). and on luck that if God has written G.C in your luck it would come to you on right time and no-one can stop it. :D believe it and always be hopeful and optimistic, you think good you will have good. :D

I made an infopass appointment for March 22. Will go IN and check the status. Hope everything will workout fine before I reach 180days.

Does your 485 denial say EAD/AP is denied?

It is difficult to interpret the max 180 days for the denied case(The applicant should get the benefit because the decision was by error.). If the decision was by error it should not be you, but it should be the person who made the mistake to be out of work.
180 days is the law/ guidelines for getting a reentry/visa or for filing 485 and I don't believe it would applied the same way for a denied case.

What is this 2nd EAD? Is it based on the same 485.

denial letter said that EAD & AP terminated.

I e-filed my 2nd EAD and AP in January for the same I485, which got approved after I received the denial letter.
 
I think you should contact a senator /congress man to help you.

I'm glad that you are assissted by an attorney atleast for MTR whom you have confidence on.

Only agency who can help you to come out of this is USCIS. Meet them in the local office and let them know what has happened and request to resolve the issue. As your case is handled in the local office they should be able to help you.

Congress man have more access than we have to USCIS. You can talk to them to resolve it.

Did you get EAD approval after MTR was filed.
