help! When will I get my renewed green card?

Hi all,

I handed in my I-751 application on 2011-6-16 and got finger print on 2011-7-18. I thought I would get my renewed green card in Aug 2011.

Company HR already emailed me that my deadline was 2011-9-15. After that, I could not work. I went to USCIS website and found out it might take them six months to process. What should I do after 2011-9-15?

Lucky I looked at the I-751 receipt again and it said that my permanent residency status was extended for one year. Can I bring this receipt and old almost expired green card to HR?

Anyone has similar experience? Thank you guys in advance!
 
Are you a new employee, or have you already been working with them after showing your green card for the I-9? They're not supposed to reverify existing employees for an expired green card.

Do you have a Social Security card without the employment restriction wording on it? If yes, you can show that plus your state ID or driver's license for the I-9 without having to show the green card. Although technically you shouldn't have to show anything if you've already showed a valid GC for the I-9. If you don't have the unrestricted SS card, make sure to visit the local SS office to apply for an updated card without the restriction. They should deliver it in about 2 weeks.
 
I have been an employee for this company for four years. I had my SSN card seven years ago.
I had H1b visa before I got the temporary green card.

But you didn't have an unrestricted SS card 7 years ago. The one you got back then had the employment restiction, something like "valid for employment only with DHS authorization" printed on the front.

You need the unrestricted SS card to be able to combine it with your state ID/DL to avoid having to show your GC. Visit the SS office to apply for an unrestricted card.

Yes, really. It's in the employer I-9 handbook, page 9:

Do not reverify the following documents:
An expired U.S. passport or passport card, an Alien Registration Receipt Card/Permanent Resident Card (Form I-551), or a List B document that has expired.

Also on page 9, if your GC has expired you can show the expired card with the one-year extension notice to satisfy the List C requirement (you would also need an acceptable List B identification such as your state ID or DL):
If an employee presents an expired Permanent Resident Card along with a Form I-797, Notice of Action, that indicates that the card is valid for an additional year, this combination is acceptable List C evidence of employment authorization for one year as indicated on Form I-797. At the end of the one-year period, you must reverify.

Hi,

Just a quick question. I was here on F1 visa and got my SS card for oncampus job. I have been married to US citizen and would be applying fr my removal of condition next month. Now my SS card states the work condition. Do I've get a new card without condition or I should be fine?
 
If your employer's HR people properly understand the rules, they won't ask you to reverify your green card while you're still with the same company.

But it's still in your own best interest to get the unrestricted SS card, it will make life easier if you have to change jobs after your GC expires, or if your employer thinks they need to reverify your GC. Doing so will also ensure the SSA has registered your LPR status.

There is no fee to apply for an updated SS card, and you can download the form for free from http://www.ssa.gov/online/ss-5.pdf. Your only cost is the time and transportation to visit the SS office.

(I do not realize that it will take so long to remove the condition from my temporary GC).
 
update: fax the Form I-797(Notice of Action) and my driver license to HR office and they take the deal to extend one more year.

Showing the receipt buys you a year. By the end of that the employer is required to get the updated information.

A small excerpt form the USCIS Employer's handbook:

Reverification and Evidence of Status for Certain Categories

Lawful Permanent Residents

Employees who attest to being a lawful permanent resident in Section 1 of Form I-9 may choose to present a valid Form I-551, Permanent Resident Card, for Section 2 (or Section 3, if applicable). A lawful permanent resident is not required to do so, however, and instead may choose to present a List B and List C document combination, e.g., state-issued driver’s license and unrestricted Social Security card.


If an employee presents a Form I-551, you should know that Forms I-551 may contain no expiration date, a 10-year expiration date, or a two-year expiration date. Cards that expire in 10 years or not at all are issued to lawful permanent residents with no conditions on their status. Cards that expire in two years are issued to lawful permanent residents with conditions on their status. Conditional residents can lose their status if they fail to remove these conditions. Permanent Resident Cards with either an expiration date or no expiration date are List A documents that should not be reverified.

Lawful permanent residents and conditional residents may be issued temporary I-551 documents. These documents are acceptable for Form I-9 as follows:

1. . If an employee presents an expired Permanent Resident Card along with a Form I-797, Notice of Action, that indicates that the card is valid for an additional year, this combination is acceptable List C evidence of employment authorization for one year as indicated on Form I-797. At the end of the one-year period, you must reverify.

2. . If an employee presents a foreign passport with either a temporary I-551 stamp or I-551 printed notation on a machine-readable immigrant visa (MRIV), you must reverify when the stamp or MRIV expires, or one year after the issuance date if the stamp or MRIV does not contain an expiration date.

3. . If an employee presents the arrival portion of Form I-94/I-94A containing an unexpired temporary I-551 stamp and a photograph of the individual, this combination of documents is an acceptable List A receipt for the Permanent Resident Card. The employee must present his or her Permanent Resident Card to the employer no later than when the stamp expires, or one year after the issuance date of the Form I-94 if the stamp does not contain an expiration date.

NOTE: If USCIS has approved the employee’s application to adjust status to that of a lawful permanent resident, but the employee has not yet received his or her initial Form I-551, he or she can obtain temporary evidence of permanent resident status at a local USCIS field office. However, you may not accept Form I-797 that acknowledges receipt of an application for an initial Form I-551 because receipts for an application for a new document are acceptable only if the original document has been lost, stolen, or damaged.
