I am a full-time student in the U.S, I started to study on June 2005 and will graduate this December 2006. My F-1 visa expired in August 2005. I need to go back to my country for 2 weeks. I need to renew my visa F-1 to continue my studies in the U.S. The thing is that last November 2005 I submitted my application to the Disersy Lottery 2007 (DV), I know this is considered as an Immigration Petition. How this will affect my chances on getting my visa F-1 extension? Does an immigration petition affect my F-1 application?

Re: Immigration

It could affect your application if the form specifically asks whether you have applied for immigration you would have to reply in the affirmative. As an F1 student, you are not supposed to have immigrant intent. You should consult a lawyer, perhaps, on what your options are.

Applying for DV program is not considered filing immigration petition. This is what most of the lawyer agrees.
I heard an interesting story that somebody went to US consulates in my country for visa stamp, and s/he answered NO to question regarding past immigration petition. Then officer turned computer screen to him/her and showed his/her DV application in the past. Then officer said s/he had to answer yes to that question. The laywer who heard this story told that officer was not right.
And most of lawyer says just applying for lotery is not considered to file immigration petition(though showing some intent). Immigration petition is I140 for EB and I130 for IR.
