Help...urgent

ok here is a update. i talked to my attorney. he said that my arrest record (btw, being arrested and then released without charges is called detention) will have no bearing on either H1 or green card. At the most there maybe a RFE. However he asked me to answer yes to the question on his questionnire and send it to him directly instead of HR and he will make sure it will remain confidential as it has no bearing on my employment either. Hope i did the right thing. Please advice. Thanks for all your support. this has been a horrible weak for me

surely it was relief getting that off my chest. now i have to wait and see hoe it turns out..hopefully for the best

Yesterday night I was thinking of your case.
You have Yes answer for arrested and No answer for charged and convicted.

If you say No, it could be wrong as we all are discussing here. Same way if you answer Yes , it is also false since you were not convicted. And you have to give only one answer.

So????? both way you are wrong and same time right.

My friend has been advised to say No. and I think both the answers can be challenged /argued if required. and since these are not big issues, these are not going to create any problem.

Anyway you had already submitted your form. But just try to convey this point to your lawyer. Many times, I have observed that if you discuss yr case with lawyer and give them reasons they accept that.
 
Thank you so much for you reply bakra. I already spoke with my lawyer in confidence and he said that is not a major problem but wanted to say yes to have it on his records. he also said that there is no reason why he should disclose it to the compnay.

I think you have done the right thing.. I see people in this and other forums had their GC approved even if they have criminal conviction
