Help....traveling in a few days

My wife and me recently got our AP and EAD cards. Neither of us have used the EAD. My H1 and my wife\'s H4 expires Oct 2002. We will be traveling in a couple of days. On our return, at the POE, do we need to show the AP? Or we do not since we have valid H visas and have not used our EAD? Appreciate if for any advice since we will be leaving in a few days.

Keep using H1/H4

In the INS AP FAQ, it specifically says that people on H1/H4 valid status need not use AP. If you are using EAD , however you have to use AP. If you are coming back before H1/H4 expiry you should use H1/H4
 
Suggestion

If you have a valid H1 / H4 then you don\'t have to use your AP. Since the moment you use your AP your loose your H1 B status. Ensure that you have enough period on your visa atleast 2-3 weeks of time before expiry. Its advisable to use your H1 B and not your AP.

You dont loose your H1B status if you use you AP , Had talked to my lawyer regarding that ,AP is purely for Travel purpose so it wont effect the person\'s H1 status at all , Usage of EAD will do that .

I am going to Use my AP next month have valid H1 till dec 2003 lets see what happens my lawyer and company\'s legal department had said it does not invalidates your H1 there is not co-relation between H1 and AP

So you mean you do not switch to use EAD before you use AP?This is very interesting since it\'s agaist with what people usually think!
