Hello:

As per AVM my case has been approved on Aug 12. I did not receive the original or curtsey copy as of now, and do have an emergency in India for that I have to go on this Friday for a week. I do have advanced parole (Valid till 2003 march), but my attorney says it’s not advisable to travel after approval but without stamping.

The point here is though it has been approved, I don’t have the documents to go to INS office to get it stamped. What are the chances I’m taking here by traveling outside using advanced parole? Any one has similar experience or know someone who has done something like this? Please put forward your thoughts on this.

Thanks

I remember someone was in the same siuation on this board before. Apparantly he/she called INS and explained them the situation and his/her urgency to travel. INS immediately sent him the approval notice in express mail. It is not necessary that same nice IIO will anser your call. But you can still try.

Thanks

Krishnagc - Thanks for your input .

Here is the information I got from National Immigration Officer.

If you face a situation like the one I explained, you can still go and come back by using Advanced Parole as long as you do not have the approval notice in hand. Automated message is not an official document. In simple words if you haven’t received the document notification from INS you are allowed to use AP for your traveling purpose. Now let’s say in a worst case scenario, where you happened to receive the documents in hand on the same day you planned to travel (I asked this question). In a case like this, you can take the documents with you and go to the consulate (home country) and get temporary re-entry card (paper document they will issue, but you have to explain the whole situation). Once you are back you can do the stamping. Thought I would share this info and hope it may help someone in future.
