Help: transfer from non-perm to perm info required

Hello,
My company has applied for my labour in RIR (Non PERM) under EB3 in October 2004 (Priority date is Oct 11 2004). I want to apply thru PERM, but my company lawyer is telling me that its even if I get my PERM cleared in a few months, I wont be able to appy for I-140 because I will be subject to retrogression. I have heard that I cannot apply for I-485 because of retrogression, not I-140. Is there a place on the any US govt website that I can ask my company to look up if there is discrepency in what is mentioned by my compant and the lawyer.
If anyone knows where i can find this information it will be deeply appreciated.

I do not think there is USCIS website saying I140 can be filed even during retrogression. It is too obviously possible, as retrogression is due to lack of visa number which play only with I-485.
Explain them what retrogression is or tell them to call USCIS to confirm by themselve.
