Help! to file AC-21 or not?

Hi Gurus,

I have decided to change my employer, do I need to file for AC-21 or not? what are the pros and cons? can I disclose it later (if need be)? someone please explain. My lawyer responded to our I-485 RFE on Oct 20, the RFE was about EVL and pay stubs, EVL was given by my previous emloyer,
on Oct 26th I recieved a e-mail stating CIS have received response to the RFE.

Please throw light on the above issue ..

I discussed this with my attorney and he suggested against applying AC-21, he says by doing that you unnecessarily bring yourself into light. If you have similar job, it's not a problem. Just send the information if they ask for it.

I have not sent AC21. I changed my employer. However my previous employer (the one who filed my GC) helped me with the RFE about company evl. Not sure what will happen. Lets keep our fingers crossed. My attorney suggested the same thing to me. He said AC21 was not needed.

I also did not apply for AC21, just took a chance.... and I got approved w/o any RFE. Have seen lots of discussion regarding whether to apply AC21 or not but I decided not to apply and take a chance. But you never now what they will do. I applied FOIA end of september just to be on safe side and it takes near about 2-3month to get all the papers. But all of sudden my case got approved.
->Got layed off on March 2004 from client side and on April 2004 from GC sponsoring employer.
->Got a new project on May 2004 changed employer started wroking on EAD.
->Did not have Labor documents.
->Applied FOIA end of Sep 2004. Got the controll no mid Oct 2004.
->Never applied AC21

If you don't do AC-21 now, be prepared to keep detailed records of the new job, when it started, what your salary was initially, what your duties were in case you need these at the citizenship stage. What you are doing should be fine (as long as the new job matches the old one) but I'm assuming that in some cases the USCIS will check for fraud at the citizenship stage...

Personally, I'd put together a "portfolio" that backs up your AC-21 case with everything you need in case the new company closes in the 6+ years between now and the citizenship stage.

One question if I may. In my situation, I have left my sponsoring company. However, due to my excellent relations with them, they gave me a letter in response to RFE about company evl.

Do in effect what they are telling INS is that they are interested in hiring me.

Now if I join them after I get my 485 approved and stay with them for 6-9 months, will I have no problem? Since 485 is anyway for future employment. Justs thinking.
