Help to decide - H1B extension or not?

Hi, everyone,

My H1B will expire in 2 months. My I-485 has been pending for more than a year and I have a valid EAD. How risky do you think it is to work on EAD without a valid H1B - Anybody knows the possibility of denial of an I-485 case?

Go for H1 extension! EAD can be risky in case you have a gap. Definitely H1. It has been discussed here several times and it always turned up to be H1 extension.

I went with it as well. But I still keep renewing EADs. And APs - I hate waking up at 4 AM to wait in front of US embassy.

But, can't we apply for EAD renewal a long time ahead of its expiration, say 6 months? I recall that there was a post saying that his EAD renewal was rejected due to too early application. Any comments?

My opinion is it depends.

In my case, my employer is sinking. so he is not sponsiring for H1 extension. So I switched to EAD as I can move on to other companies and only catch is I need to take the initiative to be on EAD and keep it going without any lapse, so is the case with AP. So there is a risk here, but that is the only option I have.

so if your employer is paying for it, go for it (H1 extn)

You can apply for EAD upto 6 months in advance, unfortunately the processing times could lag! Unlike H1 extension, applying for an EAD renewal is not enough for you to work, so either you will have to go for an iEAD like ruxrux mentioned or hope and pray that you get your EAD on time.

The best solution is to apply for H1 extension and keep EAD/AP current all the time in case you need to switch jobs like sri3440 mentioned.
 
me too - get an H1

more info:

I too have 2 years more on H1-B left and chose to get it extended. Ofcourse I have to get married to a girl in India so I had no choice other than to get the H1-B so my future wife could come on an H4.

Keeping an EAD on the side is something I am also going to do - havent done so yet.
