Dear friends, as some of you may have known, my attorney e-filed EB1A to TSC on Jan. 19, 2007, upgrade to PP 03/01/2007, got a NOID 03/16/2007. After called TSC PP line, we were suggested by an officer to re-submit the copy of original materials since the original materials may have lost in mail room as some people in this forum have experienced.
We did as suggested and the copy of original materials was delivered to Dallas April 4, 2007. LUD on April 5, 2007 showed that “Response to request for evidence received, and case processing has resumed.” Since then, no more LUD.
Today, which is Day 19 after RFE, I called the PP line again trying to figure out what is going on. I asked was it possible that the case was not touched during the 15 day period, he said the case was processed several times and just didn't reach a conclusion yet, and on day April 18, the clock for Premium Processing was stopped, and case is now in Regular processing.
I asked how, he said there must be a good reason that the adjudicator decided my case does not meet the requirement of Premium Processing (some of the possible reasons he mentioned were: NIW does not have PP available, 2 Labor certificates were submitted, bla bla, all of which does not make sense in my situation).
I was totally lost at this response, if the case really does not meet the requirement for premium processing, then it should have been thrown into regular processing pile when it was first touched, instead of stopping the premium processing clock on Day 14; and we should be informed right away instead of being given this explanation only when I called at Day 19!
I am very frustrated and out of my wit.
