HELP!!! SOOO Weird situation!!!

Dear friends, as some of you may have known, my attorney e-filed EB1A to TSC on Jan. 19, 2007, upgrade to PP 03/01/2007, got a NOID 03/16/2007. After called TSC PP line, we were suggested by an officer to re-submit the copy of original materials since the original materials may have lost in mail room as some people in this forum have experienced.

We did as suggested and the copy of original materials was delivered to Dallas April 4, 2007. LUD on April 5, 2007 showed that “Response to request for evidence received, and case processing has resumed.” Since then, no more LUD.

Today, which is Day 19 after RFE, I called the PP line again trying to figure out what is going on. I asked was it possible that the case was not touched during the 15 day period, he said the case was processed several times and just didn't reach a conclusion yet, and on day April 18, the clock for Premium Processing was stopped, and case is now in Regular processing.
I asked how, he said there must be a good reason that the adjudicator decided my case does not meet the requirement of Premium Processing (some of the possible reasons he mentioned were: NIW does not have PP available, 2 Labor certificates were submitted, bla bla, all of which does not make sense in my situation).

I was totally lost at this response, if the case really does not meet the requirement for premium processing, then it should have been thrown into regular processing pile when it was first touched, instead of stopping the premium processing clock on Day 14; and we should be informed right away instead of being given this explanation only when I called at Day 19!

I am very frustrated and out of my wit.

Sorry to hear your situation. Yes it is very weird.

YOu send an email explaining your situation to pp services and usually they are more responsible. Instead of talking orally (you won't be having any record of what you spoke and got the response from TSC) you better send the email. More effective I believe.

If your case is EB-1 EA then there is no question of so called labor certification, PP not available. I strongly feel things can be sorted out. You send all the documents (whatever you got such as the receipt notice, PP notice) as an PDF version. within a day or two you should get response.

I am in a similar situation like you. I am waiting for NOID paper notice and need to respond within 30 days. When you found that your documents may have got lost, did you resubmit only earlier documents or added new letters or papers?

I may get a couple of letters but it is difficult to generate lot of new documents in such a short time. I am thinking of hiring a lawyer now, who will rewrite the cover letter and see what happens.

I sumbitted only the copies of my original materials, did not add any new stuff.

The frustrating thing is that till now I haven't got any result yet, even the LUD is still 04/05/4007, it's been 25 days since 04/04/2007 when they received my resubmitted materials. My attorney contacted the PP service email 6 days ago, no news yet.

I do not know what happened.

Thanks for your reply. Today I received fax notice and it said that they have not received supporting documents yet. So I am hopeful that the case is not completely gone. But it is really weird that you case has not reached decision yet. I hope that your resubmitted documents didn't get lost as well.

It seems sometime these people are really careless. I mean this is so important for us and they just don't care.

I wish I could give you guys who are in the same boat as me some encouraging news, however, unfortunately I am still waiting.

My attorney called TSC several time why my EB1A was taken off from PP, all the answers do not make any sense: first they said something about labor certificate, later they said because I have another I-140 pending at the same center (which is my NIW case), making it not eligible for PP (which is not true, because only when you have 2 cases pending in the same category, you are not eligible for PP). And they said several times they are processing to have my PP fee refunded, however, I haven't seen or received any notice about this refund.

What bothers me now is that TSC is not doing work as consistently as before. And, I don't know what I can do now to change or push this situation.

What are your comments?
