Help. Quick Question about EAD and Marriage Based GC interview

Do I need an EAD...the permanent one or even a temporary EAD in order to complete the GC interview? I have a valid H-1B until end of this year and my GC interview is next Wednesday.

My EAD has been approved but there is a 6-month backlog so I won't get it for some time. I was thinking of getting a temporary EAD but my lawyer said that after the GC interview (assuming all goes well) the EAD will be useless anyway...

Anybody know if not having any EAD for the GC interview will be a problem? I have all the Receipts just not the actual EAD....my app was filed on October 27th, 2004 so all this is happening very fast.

Thanks!!

Why would you need an EAD, if you've never worked for anyone other than your H-1B sponsor?

Didn't know if you had to present your EAD at the GC interview in order for them to process the GC??? I didn't think you did but it is a line item on the checklist USCIS sent me on what to bring to the interview

"Any Employment Authorization or advanced parole documents you have ever been issued..."

So you also think that if I don't have an EAD in hand for the interview, it won't matter???

If you have not used EAD, then nothing to worry. To be on the safe side, If I were you, I would just take my EAD Receipt notice and also the printout of online approval status (you mentioned that EAD has been approved right)alongwith me to the interview. Don't worry, you will be fine.

Good Luck. Keep us posted.

I've never used an EAD. I am planning to take my EAD receipt notice but the online status does not show approval. There is a huge backlog at the NYC office...they are currently processing apps from April 2004.

Do you think the receipt notice is enough? It has the extra info that was added during the fingerprinting/biometrics.

If you have an EAD, they're asking you to bring it. If you don't have one, there's nothing to bring.

If you don't need to work (or have a valid H/L) you do not need an EAD. If you do not intend to leave the US (or have a valid H/L) you do not need AP. They are strictly optional.
