My RD is 10/12/2001 . My H1 is expiring end of this year and am planning to use EAD (planning for applying for extension this week) as it is cheaper at this stage rather than filing H1. My wife is in school doing her masters under H4 status what will happen to her status ( She has an EAD too but she didnt use it still) but how will the school know to switch her from H4 to EAD .. is EAD a status???... as she is not employed (so no I-9) .. any useful info about this?

yes EAD is a status in itself. You don't need to inform to school unless asked.
Just renew her EAD too along with yours
 
485 Pending is Status

You don't have to have EAD to stay here. EAD is for WORK.
485 Filed is a status as AOS Pending.

Don't know about school but they don't need EAD, as long as you are legal in US you can go to school.
May be you can verify.

you may wanna contact your lawyer but yes once your H1 expires your wife gets out of H4 status if she doesn't have an EAD but as you said her lost EAD is valid till next Sep so she won't be out of status. She can continue living here without any problem.But if she wants to work then she needs to apply for a replacement EAD.

And yes EAD is a staus, that's for sure. Although your wife's EAD is lost but its validity is till next Sep so she is in legal status.

Those who have doubt about the EAD itself being status please read the mailer that comes along with EAD card it clearly says that in absence of other valid status EAD is your status.


I would suggest whether she intends to work or not do apply for her EAD renewal too.
