I am a derivative applicant, my husband received RFE but I did not receive RFE in the mail.

Both of us me and my husband have the same AVM message requesting for additional evidence. My husband deadline for the submission is Dec 30, 2002. He submitted the requirements befor e the deadline , but for my self I did not submitt anything since I didn't receive any in the mail. Will that cause a problem on my case? I asked lawyer to check with the INS. As of now no response.

Did anybody experience this?

or even try talking to an IIO yourself.

Here's what happened in our I-140 case. They sent an RFE and by mistake put the state as NJ where we live rather than MI which is where our lawyer is.

The street and city addresses were those of the lawyer but the state and Zip were ours. so they couldn't deliver and the mail went back after 30 days. Then i called the IIO and as usual they said they won't talk to me. So i conferenced our lawyer in and he updated the address. Finally they re-issued the RFE and when they re-issue, the deadline changes to 30 days after the date of issue of RFE.

Your situation could be different but it doesn't hurt calling the IIO to find out what happened. Sometimes the AVM is updated but the letter is not actually sent out for a while.

nanook, I think you should call up and try finding it out from an IIO. If the mail is lost they might re-send the necessary info.

It relieved me a little bit.

I asked my lawyer to Check with the INS. No response yet.
I am having second thought to call IIO that I might say someting that will cause more trouble.

Should I just wait for my lawyer's response or call by myself?

What I am worried about is the deadline of Dec 30, 2002.
