Help please - AOS after overstay! :(

Ok.... so i have overstayed my visitor visa waiver from the uk..... and now i want to apply to adjust my status..... i was under the impression that this would be forgiven providing i am really married etc.... and i am!

But now I found things online saying that someone overstayed and then got deported with a 10 year ban.... so I am panicked. This case said the law changed in march or april of 08.... anyone else hear of this? Can this be right?

I was about to send in my forms and fees this weekend..... and now don't know what to do! Anyone?

If you are "really" married, then you should file for your AOS asap.

Overstay is *generally* forgiven for spouse's of US citizens. You can find several instances of people's experience on this site. I haven't heard about the law you are talking about. Maybe someone who has much more experience and knowledge than me regarding this can help you out.

Remember, lots of things you find in discussion forums are *specific* to certain cases and contexts, it may not be applicable to you.
 
Thanks.... we really are married..... nearly 3 years now and loving it.... we have no worries on the proving marriage thing.... we just worry about the AOS.... and yes, you are right, everyone's situation is different....

I was just worried that there was a complete change in the law so that USCIS no longer forgives the time......

search for "overstay" on this forum and you can find experiences of others in the same boat. Again, I don't know of the change of law, someone else can probably throw some light on it. Sorry..
 
don't worry about it, you will be fine. i overstayed my visa for more the three years but didn't encounter a problem during my AOS. the most important thing is that you can show that you entered legally (inspected at a point of entry) i.e. submit a copy of your i-94 if you have one.

don't worry about it, you will be fine. i overstayed my visa for more the three years but didn't encounter a problem during my AOS. the most important thing is that you can show that you entered legally (inspected at a point of entry) i.e. submit a copy of your i-94 if you have one.
