My Boyfriend applied for citizenship. He is a permanent resident in NJ. He went for the interview an pass the exams. The officer informed him that he needed more documents and to have them submitted by a specific time frame, in which he did, after some time we received a letter that his application was denied. What do we do now. Do we have to fill out the application all over again and pay the application fee. If I am not mistaken about a year and a half has passed since we received the letter of denial. Could we file an appeal, if so which form do I use. Thanks a bunch.

They asked him for a deposition, for an arrest that he had on his record. The charges were dropped. And they also wanted a receipt from the Canadian/US border.

Generally you have to file an appeal within a certain period of the denial. The letter should state that. If the window has passed then your boy friend has to file again.

In either case consult a good lawyer before you do anything.

Would we have to pay the fee again. Also would he have to do fingerprints an the exams again? Would the first application have an affect on the second one?

Yes refiling is just like intial application same fees and process.Ia m sure they will reference you old file since you are in Database..Good lawyer is a way to go.

In absence of knowing more about the circumstances of his denial, its hard to speculate when he should apply again. Take the denial letter to a good lawyer and discuss the options with them.

A year and a half is definitely too long a wait to be eligible for an appeal. Generally these have to be requested within a relatively short timeframe (~30days?). So yes, your only option is to reapply and pay another $400, then get fingerprinted over again etc, etc.

Please Tell Me This

If You Could Tell Me These We May Be Able Understand Why They Denied Him
A) How Long After You Guys Submitted Those Docs(i Am Asuming They Were Arrest Report And Court Disposition,,,etc..) You Received The Denial Letter Fom Uscis?
B)when Was His Arrest?was It 5 Years B4 You Send The N-400 Application?
C) Was It A Felony Or Misdemenour?
How Many Arrests Were There?
Please Answer Those Questions So We Can Find Out The Denial Was Legit Or ....
Thanks
