Hello!
I got married to an american citizen. For three years before that I was illegal. Now I don't know if I should file papers by myself or with the lawyer.
I have quite few quastions regarding the forms. If anybody had any similar problems and knows anything, I would appreciate advice.

1. What is my status (one of the quastions on one of the forms). I came to the US on J-1 visa. I overstayed.
2.How important is the income of my spouse from the past 3 years. One of the years is a lot below the limit. The rest meet the expectations.
3. I am emlpyed now, even I don't have work authorisation. Is it going to be a problem?
Thank nyou all in advance

Hi!
From what I've heard (and I'm sure someone will correct me if I'm wrong!) if you marry a USC, overstays and unauthorized employment are forgiven. I would, however seek the advice of a good immigration attorney, just to be sure.
I'm not sure what your current status would be, but with regards to your husbands earnings, I think the USCIS are most concerned with what he is earning now. They look at the previous 3 years to get an idea of the stability of the income. If there was a good reason why one of the years is considerably less than the others, then I would explain that on a seperate sheet of paper and attach it to the I-864 form.
Hope this helps!
