Damn.

I filed my I485/EAD/AP at CSC on April 30th (no receipt date as yet).

Now my company is planning to lay people off. There is a 50% chance
I could go. If I do, they will give me about 3 months of severence
pay which can be taken weekly so I will remain on the payroll till
about late August early September.

Hopefully my I485 will be approved by then.

What happens if my last day arrives and I still haven\'t been approved?

What proof is required to get passport stamping? Is it OK to be
out of status for even one day?

What happens if I start a new job one day after my last payroll
day of the old job.

From what I understand about this situation is that if you get approved (without an RFE or interview), you can just go get your
passport stamped, usually with no questions asked. Unfortunately,
I\'ve been seeing a lot of RFE\'s lately.

Hi Bongo,
There are several different ways you can get yourself out of this situation in order to see an approval:
1. If the company is not going down then you could basically talk to your employer and cut your salary in half which doubles the time from three to six months. Once you\'re past 6 months then you should be ok according to the new 180 rule. The rule itself is not clear but at least there is somthing official out there.
2. Also, talk to your employer about taking a vacation - it\'s kinda an unpaid leave for a short-term. That may give you some more time. I think the CSC is starting to move again to you should see an approval soon.

If it\'s not a really big company then both of these things can be worked out as I know someone who had to go through a similar situation. The important thing is to remain on good terms with the company.
