HELP... please explain I-130 case

I have a very complicated case and I really need some help understanding things a little bit clearer. I got married to my husband in march 2009, however my parents did not know or do they like my husband so they reported him to ICE. They arrested him at home in July, at that point we did not file any immigration papers. By the way, he entered with a visitor visa and overstayed about 10 years. Our lawyer recently filed the I-130 this this, I got a receipt dating sep. 10th. What should I expect next? My lawyer said she is waiting for the approval of the i-130 to then file the 485. My main concern is when will he be getting his EAD? I will really appreciate anyone who can give me some sort of time frame that I will be looking at and the order in which things will move. Thank you for taking your time to help me understand this better.
 
did ICE or USCIS start the deportation procedure yet?

you needn't worry about EAD. All you have to worry about right now is his status, his deportation orders, and the possibility of filing I-485. Of course, you also have to worry about 10 year ban from entering the US that he is facing.

Are you a US citizen? if yes, why did your lawyer file only I-130?
 
yes I am a citizen, the lawyer did file only the i-130. He entered with a visitor visa


Your lawyer is doing a disservice to you. So, you should immediately instruct your lawyer to file I-485 and attach a copy of the notice of action for the I-130. Unless this is done immediately, he's going to be deported from the US and never to return. It is easier to fight for him while he is in the US, so, get moving and instruct your lawyer that she can file all the paperwork to save him.

EAD should be the least of your concerns, him remaining and not being deported should keep you awake. You lawyer is terrible...:rolleyes:
