Help on EAD back to H1-B

Hi, I need some advice on this issue. My friend is on I485 pending status. She use EAD last year. Her H1B expired 1/5/03. Her EAD expired 1/24/03. Her EAD renew application was received at 01/10/03 at VSC and it will take 60-90 days. Her employer send her home because she can not show work authorization.

Question I: Can she use EAD renewwal receipt as evidence to continue to work? Any Legal document can support it?

Question II: If answer to Q I is No, can she apply H1B and switch back from EAD to H1B so she can start work after she got H1B receipt? ( she didn't use her AP so I assume she still on her H1-B I-94 card).

Any comment is welcome.

NO.

Probably NOT, but few people tried to switch. always wait for EAD

Q I: No
Q II: She should have applied for H1 renewal before 1/5/03. However, it is not late yet. Employer can apply for H1 renewal with premium processing. This will be faster than waiting for EAD. U probably know who will pay for the premium processing fees...
