Help! No interim EAD at Dallas!?

Hi,

I went to local INS office at Dallas to get an interim EAD card today. The officer said they do not do EAD for employment
based EAD renewal at 8101 Stemmons Freeway. Anyone
knows any other location to get the interim EAD? Thanks.

My detail: RD 06/07/01, ND 08/27/01. No FP.
 
No interim EAD in Dallas

Dallas DO does not issue interim EAD's like other district offices. Lot of people have posted on the same issue in the past in this forum. Do a serach and you will find it. If you don't have your renewal before current EAD expires I guess you have no option but to wait. You cannot be on the payroll meanwhile.
 
Thanks. Can I go to houston DO to get an interim EAD card? My address on the receipt is at dallas. But my I-485 was filed from Houston. I moved to Dallas two months ago from Houston. I already filed address change form.

My EAD is going to expire on next Monday. If I stop working, will this affect my Greencard?? My greencard applicaiton is employment based. EB2.
 
Do you have a valid H1 at all? If so, you can always switch to H1. Else it's bad luck. The last person who got approved was in 104 days. You'll near that mark sometime next week. So you won't be out of work long.

As far as affecting your I485, I don't think that's a problem. When people can join a whole new company (possibly with a few days gap in between), joining your same company is acceptable.

U can still get EAD at Dallas

My lawyer said that even though they do not issue INTERIM EAD, the HAVE to issue the EAD itself per law if it has been over 90 days since you applied. Apparently one of his other clients did get her EAD ( not interim ) from the Dallas office recently, INS simply rejects your pending EAD application.
They deduct the time since you applied say 100 days, from 1 year, and so you have 365-100 = 265 days before your new EAD expires.

Q. There has been a policy not to consider employment unathorized if an EAD extension is timely filed, and the previous work authorization expires before the new one arrives. TSC has been granting work authorization extensions as valid showing a start date as date of expiration of the previous EAD rather than the date of approval. Is this still policy?

A. Yes, the TSC will continue to grant employment authorization extensions which will be deemed valid as of the date the previous employment authorization expired as long as the application for extension of employment authorization (I-765) are timely filed.

Hello All, I went to the dallas district office today and got an dublicate ead card. here is the whole story.
6:18Am reached the office, was stunned, lots of people in the line.
7:40Am got inside the office, there after security check, had to be in another line, where we were supposed to the a token. At that point the person looked at my I765 and asked me to go to room 3. I went there, luckily a person was out asking for some one else I told her that the person a token counter told me to come here, but she looked at my I 765, said there is nothing she can do until there is a stamp. Asked me to go back to the person who gave token. I went back, the guy told me to go back, and wait, he will come by there.:D so I waited for few minutes, went back to the guy at token counter, to remind him, he came, went into the room and then came back, took a few minutes to look up a phone number, dialled that number, spoke for few minutes and then came back and gave me a token, phoof.

4. Now the wait started again, about 11:30a, my number came, i went to the counter, gave there the original I765 receipt, and she asked for old ead card, had a application filled already, she looked at all the papers, and put some instructions on the form and asked me to go back to door 3 and put the application.

5. 11:40a the same person who I talk to earlier came out, asked me to go in with her, took picture, made the card. The card came out real light, but I did not want to ask here to make me a new one.

hope this helps all, the thing is to get the token and the officers at the counters are pretty patient and willing to hear.
 
Which category is your EAD card renewal? Mine is C09. I am the primary applicant of the Green card. The lady at the counter told me they do not issue the interim card for this category.

I went to District office at 8101 Stemmons Freeway.

Hi,
Yes, I went to 8101 Stemmon hwy, the red 2 story building, also my category is C9. I know there are persons that do not know all the different types of application, see if you can get a token and talk to an officer, that is much more helpfull.

I think, the people in room 3 only do what they are told, and do not have the knowledge to guide people, except to tell them that they cannot process!, but if you talk to the person giving tokens and explain to him, he will give you a token, that way you can talk to an officer.
 
I did get the token and talked to an officer. The lady did not want to give me the token at first, then I told her the INS website said I can get an iterim EAD. She then gave me the token, said I will get nothing after waiting for hours. The officer I talked to said the same thing. Maybe I should try to get there on Tue. Anyone else get the interim card at Dallas DO?

I talked to IIO, they are processing EAD on July 31.
 
Paid vacation while awaiting EAD?

As I have posted earlier, my EAD has expired (yesterday) and my H1 expires on 11/22/02. My lawyer suggested not to do anything, just let the H1 expire and wait for the EAD renewal to be approved. He said I could continue to work in the meantime (even without EAD!). He didn't think it would be a problem since my EAD renewal is in process.

What do you guys think? My feeling is that if I don't get my EAD before 11/22 when the H1 expires, I will take a week's (or two weeks) PAID vacation, so technically I am not working even though I am on the company's payroll.

Bad Idea?:confused:

You can not do paid vacation. You can ask your company to remove you from the pay roll temporarily.

DALLASWAIT...you seem to be contradicting yourself between 1. & 2. :

FROM 1. ABOVE , YOUR LAWYER SAID ITS O.K.


2. You can not do paid vacation. You can ask your company to remove you from the pay roll temporarily.
FROM 2., HE IS SAYING YOU HAVE TO GET OFF THE PAYROLL, OTHERWISE YOU MAY BE IN "TROUBLE".

IF THE LAWYER THINKS IT'S O.K. HE REALLY SHOULDN'T HAVE TO INSIST ON GETTING OFF PAYROLL..:confused:


I wish INS regulations would be more clear on the above subject.
