Hi I am a Canadian resident (PR).
I had sponsored my mother to become a PR (through Buffalo).
She got her landing papers, etc, everything. She tried to land in Canada (we actually drove through). (I had landed a long time ago in 2001).
However I was accompanying her.
She was refused landing because the office said that I(her sponsor) had been outside Canada. When I told them that I was in Canada for the most part but was unable to find a job and had to look for a job in the US AND that the Buffalo consulate was aware of it.
however she was refused landing and I was told to approach Buffalo with more proof etc. etc.
My question is : I am now getting a job in Canada( am now in the US). should we try making a trip to Buffalo and explaining the new situation to the consulate or shoudl I hire and attorney and let them deal with it?

When did you land in 2001? To remain PR of Canada you need to be able to prove physical presence in Canada for 2 out of the last 5 years.

If you - say - landed in August of 2001, you should not have any problems, as you could tell immigration officials, that you are able to fulfill your residency requirement by being physically present in Canada August 2004-August 2006, and there is nothing they could do about it, since these dates are in the future.

If you landed before August you will have to count the days you actually spent in Canada. Chances are you are still a PR of Canada, but it gets more tricky.

please followup

Hi Canadian
thanks for your reply. I think my post was not clear. The issue is with my mother. The problem is that my PR is fine(so far) but they did not let my mother land because I had not physically stayed in Canada for the entire time during her sponsorship process.
The situation has changed now as I will be staying in CAnada full time since I am getting a job. My question is should I go back with my mother to buffalo and tell them that they should let her land now or should I hire an attorney.

thanks

It has to do with your not staying in Canada, as it suggests to CIC that you sponsored your mother but you yourself can't prove your residency. So your mother won't have prob if she goes on her own. As at that time, they are just looking at her immigration papers. Again that is my openion.

You all are missing the point . The person has to be a physical resident of canada to sponsor anybody , and he is not . He may be a PR according to the new rules but he was not eligible to sponsor anybody as he was outside canada.

If the buffalo consulate knew about it, he was asked to get proof for it so In my opinion he should get that ..

Thanks bhand11683.
The situation now is that I have just got a job in Canada. I am scheduled to start Aug 4th or so. ( I am in Richmond, VA now.) should I go with my mother to the buffalo consulate and tell them that I now have a job in canada and ask them to reconsider? or should I go to canada work there for some time and then try it. The problem is that once I go to canada I cannot come back soon enough because I would need a US visa. Also, I cannot leave my mother alone in the US while I am gone... Any suggestions. Should I just abandon the whole thing and reapply, what sort of problems could there be?

anyone!!.. please help..

Only Thing I can say is

Ask your mom to go with some one else (who can enter canada) to the border
and try landing without you . If that works great and you can follow later otherwise contact an attorney . I am also surprised that Buffalo allowed you to sponsor if they knew you lived outside canada , It would also be good for you to get the proof what ever the immigration inspector is asking
