Received RFE. BCIS asked for employment letter from original company sponsered I-140. Changed job before 180 day after submitting I-485. Do I have to ask for employment letter from previous employer or I can ask my current company to submit one for me?

RFE

I plan on sending the employment letter from my current employer. I did not inform BCIS of change of employer. They would have no idea that I had left the I-140 sponsering company. The RFE reads: Please submit a letter from the company that sponsered your I-140 with a description of your current duties...

RFE

Also, the RFE asks for form I-360. I-360 is a form for widowers, international government employees, and other special persons. None of them applies to me. I don't understand why I get such a request. Should I just ignore this? Or this is common practice by BCIS? Anyone got similar request?

Please make sure your previous employer did not revoke your I-140 or notify the INS(technically they can since <180 days, AC21 does not apply). Enter you I-140 EAC # to the online status check to verify.

AC21

I think this issue has been debated a lot of times. One does not have to wait for 180 to change jobs. The only chance that the I-140 can be revoked by sponsering employer is that one leaves before 180, company notify INS immediately, and INS act on it before 180. If my I-140 has been voided by previous employer, why am I getting RFE? They should have denied my case already. Thanks for your advise anyway.
