Help Needed ..I140 & I485 denied.

My I-140 and I-485 got denied, I don't know the reason ( I haven't got the letter for USCIS yet.)

My six years of stay will be over by Feb 2005. Also my company has applied for 7th year extension which is pending.

Will that 7th year exetension of my H1B petition will be affected by the denials of 140 AND 485 petitions?

Can I apply for 7th year extension of H1B through other company based on my approved labor ?

What is the next step ?

Can I appeal or request for MTR ?

Kindly advice me in this regard.

Sorry to hear that. You need to know, why they have denied the case and for what reason. If they have denied without verifying all your records, then you can just file for MTR, else you have to appeal it with more evidence.

In Either case, you need to file MTR or MTR/Appeal, else your H1 extension will be denied too. As long as your case is pending (not final decision), which includes appeal too, you are in status and you are eligible for extensions and you can continue to work.

My other suggestion would be, if you think your current 140 may not be approved, look for labor substitution with some other company and start your 140/485 ASAP.

Sorry to hear that. Once you know the reason for denial (education or ability to pay), please write back. There are many people like me who are in the same boat and we can help you with suggestions. Also seek out user "marooti". He can help you with your 7th year H1B extension.
