Help Needed : can spouse travel outside US after applying for I485

Hi All,

Any help in the following regard will be greatly appreciated.

My wife will be coming to the US after marriage this month and we will be applying for I 485 immediately afterwards. My I140 is being processed currently. Since she needs to complete some studies in our home country (India), can she go back to India after applying for I485 here ? If so, does she have to wait to get the I485 receipts before she can travel outside for extended periods ? Or can she just travel on valid H4 ?

Sure, if on a valid visa.

After filing I 485 you guys may need to go for finger printing on the date fixed by INS. After that is over she can travel and stay outside USA and come back in atleast after the aproval of the papers or before the visa expiry...

( This is my opinion. Please do your own analysis )



Hope she can travel after filing the papers.
