I filed my asylum application in 2004 but my case got dalayed cos of swicthing lawyer and judge postponing my hearing at latter dates!
I came to US in late 1999. I don't have problems with the one year deadline issue cos that was not the reason why I got rejected at asylum officer interveiw but rather inconsistencies and my case was reffered to IJ for hearing!
Furthermore, I have my pshcoligical reports from two psychologists detailing the truama I suffered from torture and further trauma cos my parents died within also one year of my arrival in US. I also have one pshychologists testifying at the hearing for me! So I have qualifications to file beyond the one year deadline due to many extra ordinary circumstances!

My final hearing with the judge now is coming in less then a week and I really want asylum cos I waited too long and I have a strong case!
The gov will have an interpreter for me at the hearing cos I said my english is not fluent in the application.
Pls tell me about how the court proceeding works?
Will I and my lawyer and my pshychologists be allowed enter the court room before the judge at the same time or They will be told to wait outside until I am done cross examining by my lawyer and the government lawyer?
How should I respond to the questions from judge and how and what kind of questions will the government lawyer ask me?

How long your hearing lasted beofre the judge? 1 , 2 3 , 4 hours?

Pls, give me some clue about what to expect to be questioned by the Judge or goverment lawyer and your expereince at the hearing in the court room.

Thank you

action6: You will be asked about your case and the reason why you are seeking asylum. The judge will go over you application and start asking questions from there.

Memorize your case. Memorize dates and names. Limit your answers as much as you can. Don't talk to much and don't offer information that's not been asked.

The time it takes depends on the judge. It could be 5 minutes or 5 hours.

I am kind of in a similar situation. I have been involved with the immigration courts for over a year now in New York City. In November 2006 my brother and myself were cross-examined by the DHS attorney as well as the immigration judge. Since our case was been heard together, my brother was allowed to stay in the room as I was interviewed and vice versa. Some of the questions were the same other were not. We went without an attorney. Our case is little bit tough. We had the one year issue as well as our parents have been living in a third country for a long time and the DHS attorney was lobbying hard for us to be deported to the third country.

One thing you should be aware is most of the questions come from your application. You are not allowed to have your application or any other notes infront of you while you are cross-examined. You could have a very strong asylum case but what you say and what you wrote does not match then you have a problem. We were cross-examined for two and a half hours and the whole proceeding was recorded. We go back to court on 01/22/07 for our verdict. I just hope we get it.

Hope this helps. Wish you the best of luck and keep us posted.

when you go to court remember few things.
Be well informed to your application information and story that you filed. Be specificed while you answer questions, do not volunteerly pass the information that not asked to you. while you explain dates and time and circumstrations, try to describe as less as much. Do not insist of any information if you are not sure that are in your story or not. Good Luck....... :)
