Help Needed Asylum Case

sorry i am not too smart in legal stuff...what that means is...if he doesnt get Nunc Pro Tunc approval he can be deported to India???


No it says that asylum status can be terminated at any time.
If circumstances in Country of Persecution(COP) changed, another words if current government is no longer exist. And a lot of good changes happened in COP
 
The only way you can this question is after he does the interview. It is premature at this time to worry about that...you should focus on winning the case not losing it...by the way does he has interview date set?

No, he is filing at this stage with the lawyers. and he told me that if his Nunc Pro Tunc gets declined then he doesnt want to go back to india and live as an asylee whole his life...this will be a very big disadvantage on me becuz i cant come to US .....i can only go there on a visa wavier ...

So if his Nunc Pro Tunc gets declined, i assume he can still stay in US right??

If you are so worried that the case will be denied, he does not have to file the nucn pro tunc. If he does not file the nucn pro tunc, his greencard application will be denied, but he can retain his asylum forever....his asylum will not be touched. They are two separate cases. If does not file the nunc pro tucn, the uscis will not deny his asylum, but they will say because you didn't apply for nunc pro tunc we have denied your application for greencard....

if he doesnt apply...that will mean that i cant come to US becuz he cant sponsor me.....if he wants to stay in US whole of his life as an Asylee.
