Hi !
I am an Indian citizen and I'm 18 years old. I have my uncle residing in the US (my dad's brother) who had sponcered my dad. So my family had gone to the US about 10 years ago and everyone of us got the green card. My elder brother and sister decided to stay in the US whereas me, my dad and mom returned. Eventually, our greencard expired as we werent able to renew it, but my brother and sister became citizens of USA. Now, my brother is sponcering my dad and mom for immigration. What I want to know is that if I'm younger than 21 years old, will I be able to go to the US with my mom and dad or will my brother need to file a separate sponcership for me ?

Please Reply ASAP as this can change my life.

Thanks in Advance.

You will NOT be able to go with your parents, your brother will have to file a seperate petition for you, the current waiting time for F4 for that category is 12-14 years. OR your mother could petition for you when she arrives in the US., the current waiting time is 5-6 years

hey, thanks for the reply... but there are 2 more questions i want to ask :

1) My agent said that i have good chances of making it to US with my parents and even though i know that you would be a knowledgable person to answer this, are u sure about it ?

2) If i go to US on student visa and my mom and dad go to US based on my brother's sponcership, can my mom file a petition for me even though i'm already there on students visa ?

thanks in advance

A1:Your "agent" is either a crook or someone with no real knowledge about US family based immigration.
A2: Your mother can sponsor you for a green card (after she gets hers and moves there) independent of the fact whether you are in the US or outside the US.
