HELP! Need info on I-485 application

I am about to apply for I485 through my company lawyer. But, my lawyer just informed me that because my wife had worked illegally in the past, we might be ineligible to apply for the Green card.

Is there some way that I and my wife can apply at this time? I had applied for the LC early 2001, and my I-140 had gotten approved Nov 2001. Got Married Jan 2002.

Depend on the days she illegally work. If the days less than 180, she is ok.
 
<180 days rule

I have not seen such a rule anywhere in print. Could you point me in the right direction please?

Here is what I know.

As long as you did not file a W2 or any other papers then you should be ok. Did she get paid under the table and not pay tax if so you will be fine. Don\'t tell anyone she worked because there is now record.
 
Appy under 245(k) if she worked ...

without authorization (illegal) for less than 180 days.

Apply under 245(i) if the period is &gt; 180 days. You have to pay $1000 per person as fine in this case.
