dear frinends,
our company(consulting) is in san jose.my 485 is pending in CA Service center.our company is not doing well.they closed their office and moved their office to their apartment.is it going to be any negative impact at the time of rfe's like company details such as company photo etc,.waiting for your valuable answers
 
Once you reach 485 stage , this should not matter as long as they give you a EVL if and when it comes. Don't let this bother you, atleast for now.
 
Also, if you are past 180 days, since 485 filing (RD), you might want to look for more stable employment using AC21, in same or similar occupational classification with same or higher salary.
 
gurus - i value your advice.

Dont know about EVL RFE yet as i havent reached that stage - several months of waiting in store for me.

question i have though is what value is the EVL if they cannot verify anything about the company that the person works for.

while 'photo of office' would be a poor indicator of the existance of the company - financial statemtns would be a better indicator - clearly if the company is in an apartment - it probably doesnt have a finance department.

what then? Does the financial stability, health, existance of the company not matter at all - i can get a friend of mine to incorporate some company in delaware - get him to sign me on in the same title and maybe even more salary (paper money) and submit EVL? Does this happen?

Dont want to cheat - but want to know if this happens.

I know this kind of pseudo sponsoring happens. WIthout taking any names I know of atleast one company which was already established though small and one close associate of that company was laid off with a 485 pending 200+ days. They got the person in via an AC21 with similar job description et al and the person now has a valid GC stamped and all

EVL does not give the Fin status of the company, it just says that you are employed by so and so company ina so and so position. It could be a bakery for all you know, but if the job title is the same should'nt be a problem ( AC21). If you are working for the same company that filed H1 then you are fine if you've cleared the I140 Stage.

Also the fin status of the company usually comes into the picture at the I140 stage . If that is cleared most probably this won't be an issue.
