Help me settle a Deportation argument?

Hi all -

Please help me convince my friend :)

He's decided to maybe enter the USA for 90 days via the Visa Waiver Scheme/Program and not return to the UK.

It's his belief that upon being caught, all he would face is a $100 fine.

I don't believe this at all, I'm certain he would be deported and disallowed to enter the United States for the rest of his life.

Who's correct?

He can't be spoken to and I need to prove him wrong as I'm worried he's seriously going to try.
