I have been in USA for 5.5 years and a company recently appled for my H1b. My H1b is granted only for 6 months remaining to complete 6 years as I have been on H4 so far.
Now the comapny wants me to go to Canada in October 3rd week for one year to reset the clock and wants to apply for my H1b for next year quota with a start date in Oct 4th week.
My question is: What are my chances of getting H1b in 2007 quota since when the company applies for H1b in April 2007 requesting start date as Oct 4th week(exactly after my 365 days' stay away from US)? I would have only completed 7 months' away from USA?
Is it necessary to have completed 1 year away from US AT THE TIME OF APPLICATION FOR H1B or at the time WHEN EMPLOYMENT STARTS ?
