I need some help and advice from you guys, you seem like you know what you are talking about.
I came to the United States in June, 2003 when I was 13 with my family and a green card.
In September of 2009, after five years of good moral character, I was arrested for Drinking while underage. I was at a college football game and drank heavily at the tailgate. I got picked up by campus police and was compliant and nice to them throughout the whole thing. I blew a .14 at the time I was arrested and then a .23 in jail. I spent 14 hours in there with a bunch of other teenagers while waiting to blow a .00 . I pleaded guilty to my charge of "MIC, minor in consumption of an alcoholic beverage." and was charged with a misdemeanor ( leg.state.nv.us/nrs/NRS-202.html#NRS202Sec020"This is the law that I broke)
The judge ordered that I take a substance abuse evaluation and I did. The evaluator said I am not an addict but gave me a substance education class because "she was required to give me some kind of punishment". I paid for all the classes and apart from this incident, I haven't had as much as a traffic ticket.
My question is, is this a CIMT? If I apply now, in March or April of 2010, do I have a big chance of being denied? I am going in Monday to talk to an immigration lawyer about it too.
