Hi all,

Please help me, my case is:

I have valid visa stamp till Apr 2007 with previous employer, I changed my employer 6 months back and I am working with this company. I got new H1 Approval till 2009 with I94.

Actually my problem is:

I am planning to go India in Jan 2007 and again I will come back in Feb 2007. By that time, as per my visa stamp in passport will remain 2 months (because my visa stamp on passport till Apr 2007 with previous employer)

1. Will port of entry people allows me into US with 2 months validity stamp with old employer?
2. Do I need to show original H1 B with second employer at port of entry?
3. Can I enter with 2 months Validity stamp with previous employer and H1 Approval with new employer till 2009? Or Do I need to get the stamp from India?


Please give me your guidelines.

----YES, show the valid Visa stamp in your passport AND H1 transfer approval and you will get I-94 till 2009
2. Do I need to show original H1 B with second employer at port of entry?

Or
Do I need to get the stamp from India?
------------------After April 2007 you will need New Visa stamp to enter US.

Hello,

As long as you have a valid H-1B stamp in your passport you would not face any problems at the POE. But then also for safety purposes do carry the actual H-1B petition approval notice for both the H-1Bs.
